Standard Terms and Conditions

These Standard Terms and Conditions set out the general terms on which Wild Legacy Safaris (“WLS”) undertake any business:

1. “Client” or in these terms refers to any individual or company who makes a booking / makes a booking enquiry with WLS.

2. The client is aware and consents to WLS processing its personal information in so far as necessary for business purposes in terms of Protection of Personal Information Act 4 of 2013 (“POPIA”). The client further consents to its necessary personal information being shared by WLS with any third-party service providers who may be booked by WLS to perform part of a service related to that/ those clients, such as, but not limited to guest transfers, spa experiences etc. The client is also aware that the Klaserie Private Nature Reserve (“KPNR”) is
a protected wildlife area and subject to its own rules, constitution and security protocols. The client consents to WLS providing its personal information to the KPNR for purposes of the client’s access to and stay in the KPNR.

3. Travel insurance is compulsory for all international clients and the sole responsibility of the clients, covering for cancellation, personal effects, personal accident, medical and emergency travel expenses.

4. All bookings, and any amendments, alterations, confirmations, special requests or cancellations are the sole responsibility of the client and are to be made in writing by email to WLS. Such bookings, amendments, alterations, confirmations or cancellations are only considered to have been received by WLS on written email acknowledgment by WLS.

5. All quotes / estimates / invoices are quoted in South African Rands and subject to availability. All quoted tariffs/ levies are subject to change without notice.

6. All bookings are subject to WLS’s payment and cancellation policies as contained in this document.

7. A provisional booking will only be held for a client on a client’s written confirmation that it would like to proceed with a booking on or between dates. A provisional booking only becomes a confirmed booking on payment of deposit. A provisional booking made more than six months before date of arrival will be held for a maximum of 10 working days from date of booking, a provisional booking made less than 6 months but more than 30 days before arrival will be held for a maximum of 5 working days from date of booking, and a provisional booking made less than 30 days before date of arrival will be held for a maximum of 48hours from date of booking. Any provisional booking which has not become confirmed by the client by payment of deposit within the holding time periods as aforesaid may be released by WLS without further notice.

8. Should WLS receive a booking request for dates being held under another client’s provisional booking period (‘the first client’), WLS reserves the right to request confirmation / payment of deposit from the first client on 48 hours’ notice, failing receipt of payment, the first clients provisional booking may be released at WLS’s discretion.

9. A provisional booking only becomes a confirmed booking on payment of a deposit. The deposit totals a cleared payment of 25% of the entire booking amount as confirmed by WLS paid into WLS’s nominated bank account. Such deposit is to be paid within the holding periods as detailed in these terms, failing which, the provisional booking will be automatically released. The balance of payment is due 45 (forty-five) days prior to the client’s arrival, or within whatever other period whatsoever specified by WLS.

10. PAYMENTS in full are to be made via EFT to WLS’s bank account, free of any bank, exchange or other charges, and proof of payment mailed to booking@wildlegacysafaris.co.za

11. CANCELLATIONS of all bookings or part bookings from clients are only accepted by written notice by email to bookings@wildlegacysafaris.co.za and evidenced by an email read or delivered receipt. In terms of the Consumer Protection Act 68 of 2008 WLS is entitled to impose cancellation fees as follows: cancellations more than 45 days before arrival, deposit forfeit; cancellations 31-45 days before arrival, deposit and half of remaining balance of payment forfeit; cancellations within 30 days of arrival, deposit and remaining balance of payment forfeit. A client who does not arrive for their booking will still be obliged to make payment in full for the booking. Nothing in this clause prevents WLS from unilaterally cancelling and/or releasing provisional bookings where a deposit has not been paid
timeously without notice, or from cancelling or releasing confirmed bookings on notice where a balance of payment has not been made 45 (forty-five) days prior to the clients’ arrival.

12. Wild Legacy Safaris shall not be liable for any failure or delay in the performance of its obligations where such failure or delay is caused by events beyond its reasonable control (“Force Majeure”), including but not limited to severe or unsafe weather conditions, floods, fires, drought, acts of God, epidemics or pandemics, government restrictions, travel bans, road closures, power or water supply failures, civil unrest, or any other circumstances beyond WLS’s control that make it unsafe, impractical, or impossible to provide accommodation or activities. In such circumstances, WLS reserves the right to cancel, amend, or curtail a booking at short notice in the interests of guest safety. Where a booking is cancelled by the Lodge due to such an event, WLS will, at its discretion: a. offer alternative dates (subject to availability), or b. issue a credit voucher valid for a future stay, or c. refund payments received, less any non-recoverable costs already incurred. No refunds or compensation will be payable for any additional costs incurred by the guest, including but not limited to travel, transfers, accommodation elsewhere, or consequential losses.
